Know your rights.

In Montgomery County, too many renters are rent-burdened. Many residents are not only struggling to make ends meet but also living in deplorable conditions that consistently jeopardize their health and quality of life.

Please remember that the tenant protections listed below are applicable within city limits in Dayton, Ohio.

Pay To Stay 

Before your eviction hearing for non-payment of rent, you or someone else can pay all your past-due rent with reasonable late fees. The landlord must accept the tendered payment and allow you to stay.

Escrow

To escrow:​

  1. Ensure you are current on rent and provide your landlord with written notice of the acts and code violations/complaints.

  2. Provide 30 days for the landlord to remedy complaints.

  3. Bring your full rent payment to court to initiate the escrow process.
     

What to do after you file escrow.

Source of Income

A housing provider within Dayton city limits can not refuse tenancy to an applicant based on their source of income. (Section 8, social security income, etc.)

Eviction

The eviction process from beginning to end can happen in less than two weeks. If your landlord fails to serve a 30-day notice or serves the notice without the required language, it is invalid, and a court cannot evict you.

Late Fee Caps 

The total fee your landlord can charge you should not exceed the larger of $25 or 5% of your monthly contract rent amount.
